Criminal Trial Process/ District Court Attendance 

Andrew Vallely and Andrew King attend court nationwide daily. From our base in Dun Laoghaire, we have built a nationwide reputation in criminal defence and represent our client's interests daily before the courts. We have a dedicated Trials Department which deals with serious criminal offences before the Circuit Criminal Courts nationwide and before the Central Criminal Court. 

Extradition

Andrew Vallely and Andrew King deal with extradition matters before the High Court regularly. Our solicitors are fully familiar and experienced in representing our client's interests before the High Court and on Appeal in respect of extradition requests. Our solicitors have dealt with such matters on a privately retained basis and pursuant to the Legal Aid Custody Issues Scheme.

Judicial Review

Andrew Vallely provides expert Judicial Review advice to a cross section of clientele. These advices range across both criminal and civil decision-making processes against which relief is sought before the High Court. Andrew has advised clients in respect of matters touching on Orders made in the context of criminal proceedings and in respect of matters concerning appeals against decisions of the Department of Social Protection and decisions of Boards of Management of Schools and Education and Training Boards.

CRIMINAL PRE ARREST ADVICE

Garda Station Attendance/ Interviews

Criminal investigations generally take place on foot of a complaint being made to An Garda Siochana or other State Agency. Where a person is accused of a criminal offence it is vital that specialist advice is received from the point of first contact by the investigating agency/An Garda Siochana.

 

Andrew Vallely and Andrew King provide expert advice to clients against whom an allegation has been made. An accused person may likely be arrested for the purpose of a criminal allegation being fully investigated, involving the person being detained by An Garda Siochana under legislation for questioning. 

 

Any person who is arrested is entitled to receive legal advice and reasonable access to a solicitor in custody. Andrew Vallely and Andrew King advise clients in custody as to the case against them and any defence which may arise. This advice extends to a solicitor sitting in on interview with clients when the allegation is being investigated.

 

Early expert representation in respect of criminal allegations is key.

 

Often being questioned at a Garda Station can be an upsetting and stressful experience. An accused person may be asked to attend at a Garda Station for the purpose of a Voluntary Cautioned Statement or interview. This involves a person who is suspected of a criminal offence being interviewed under caution, which may have the effect of any response or point of conflict being later used in criminal proceedings against the person.

White Collar Crime 
(Theft and Fraud/ Money Laundering)

In the main, "White Collar Crime" investigations are investigated and subsequently prosecuted under the Criminal Justice (Theft and Fraud Offences) Act 2001 and the Criminal Justice ( Money Laundering and Terrorist Financing) Act 2010 as amended and the Criminal Justice (Corruption Offences) Act 2018.  Often, such investigations commence under search warrant and with the arrest and detention of a suspected person at a Garda station or on a voluntary cautioned basis. A person may be tried summarily before the District Court by a Judge sitting alone or on indictment before the Circuit Criminal Court by a Judge and jury.

 

Andrew Vallely has extensive experience in advising on these matters from the point of arrest and interview through to prosecution and trial defence.

Sexual Offences

Andrew Vallely specialises in this area of law and advises daily in the areas of Rape, Sexual Assault and Aggravated Sexual Assault, Defilement, Incest and historic abuse allegations. Andrew also advises in respect of allegations contrary to the Child Trafficking and Pornography Act 1998. Sexual Offence allegations are usually complex in nature and require the early input of an experienced legal representative to adequately safeguard the rights of an accused person being investigated.

Misuse of Drug Offences

Misuse of Drugs offences are mainly investigated under the Misuse of Drugs Act 1977 as amended. Allegations of personal possession of drugs and allegations of sale and supply of drugs are prosecuted before the District Court and Circuit Criminal Court. 

 

A person arrested for alleged drugs offences can be questioned under the Criminal Justice Act 1984 as amended and the Drug Trafficking Act 1996 as amended. 

 

The timeframe for such detention varies depending on the level and scope and alleged value of the offence being investigated.
